Award-winning solicitors Rachael Liston and Clare Flavin have set up their own specialist medical and professional negligence practice. The new practice – Liston Flavin – will focus on securing justice for clients and making the health service more accountable, say the partners.

Rachael and Clare represent clients from all over the country, but their head office will be based in Greystones, Co. Wicklow. The two women previously worked together at Orpen Franks, where they headed up a medical negligence department and were winners of Medical Negligence Law Firm of the Year at the Irish Law Awards in 2019.

Rachael is best known for high profile cases involving baby deaths at Portlaoise Hospital and exposing breast cancer misdiagnosis in St James’s Hospital. She won Dublin Solicitor of the Year at the Irish Law Awards in 2017. She has appeared in several Primetime Investigates programmes in relation to exposés in the Irish health system.

She says the new practice aims to secure justice for their clients, in a compassionate and professional manner. “We leave no stone unturned in our investigations and seek answers and apologies for our clients”.

“We instruct leading medical experts throughout the world to advise and assist in relation to medical negligence actions.  We try to make sure that our client’s focus is on recovery and/or dealing with grief, rather than on the stress of litigation.  We strive to make the Irish health system a better place for all, so that mistakes of the past are not repeated.”

Rachael, originally from Cork, is a UCC law graduate and qualified as a solicitor in 2001.  Her grandfather, the late TK Liston, was a well-known Senior Counsel and was involved in the landmark medical negligence case of Dunne v National Maternity Hospital.  Rachael began specialising in medical and professional negligence shortly after qualifying as a solicitor. She now has almost 20 years of experience behind her.

Her partner in the new practice is Clare Flavin who also hails from Cork and is a UCC law graduate, qualifying in 2009.  Rachael and Clare worked together on many high-profile cases whilst at Orpen Franks.

Clare says that they understand how devastating it can be for individuals and their families when a loved one is seriously injured. They also know how daunting the legal process can be in those circumstances.  “It is very important to us that our clients feel as supported as possible throughout that process.

“We know that beyond seeking damages, it is about getting answers for people. It’s about understanding exactly what went wrong and why.  We carry out exhaustive investigations and help people to get the answers that they deserve.”
