What is Surgical Negligence?

Surgical negligence claims arise when mistakes occur during surgery which result in the patient being injured.

All operations/surgical procedures have risks associated with them. Sometimes, patients receive substandard care or there may be a failure to follow hospital protocols or guidelines. When surgical errors and mistakes occur it can have serious consequences or be fatal. This may result in a medical negligence claim.

Surgical Injury Claims

Examples of the types of mistakes that can result in a medical negligence claim are:

$
Foreign object left in body during surgery
$
Wrong surgery is performed
$
Operated on the wrong part of the body
$
Sepsis caused by infection
$
Too little or too much anaesthesia
$
Severed an artery during surgery, causing death or amputation of a limb
$
Damaged nerves during surgery
$
Failed to inform patient about the risks of the surgery
$
Excessive fluid absorption during surgery
$
Lack of skill during surgery
$
Poor post-operative care

Consent prior to surgery

Unless there is a medical emergency, surgeons are required to obtain consent from the patient to have the specific surgery in advance of it taking place.

When a procedure goes wrong, a patient may wish they never had the surgery. It is important to consider the alternative options available to a patient when discussing the issue of consent and considering whether to pursue an informed consent case.
